The University of Oum El Bouaghi adopts a comprehensive Maternity and Paternity Policy in accordance with the provisions of Algerian national legislation governing labor relations and public service employment. This policy ensures the protection of parenthood rights, promotes family well-being, and guarantees equal treatment for all staff members.
2. Legislative References
This policy is grounded in two main legal instruments:
a. Labor Relations Law – Law No. 90-11 of April 21, 1990 (26 Ramadan 1410)
This law governs employment relations in Algeria and guarantees maternity and paternity rights as part of workers’ welfare.
- Article 55: Female employees are entitled to fourteen (14) weeks of maternity leave, to be taken before and after childbirth. They also benefit from specific facilities, including paid breastfeeding absences, under conditions established by the institution’s internal regulations.
- Article 56: Employers may grant unpaid special leave to workers who have urgent personal or family needs, subject to the internal rules of the organization.
b. General Public Service Basic Law – Law No. 06-03 of July 15, 2006
As a public higher education institution, the University of Oum El Bouaghi adheres to the provisions of the General Statute of the Public Service, which further details maternity, paternity, and family-related leave entitlements.
- Article 212: Employees are entitled to three (3) days of unpaid special leave on occasions such as marriage, the birth of a child, circumcision, marriage of dependents, or the death of a spouse or close relative.
- Article 213: Female employees are entitled to maternity leave as stipulated by the applicable legislation.
- Article 214: Nursing mothers may take up to one (1) year of authorized absence following maternity leave, during which they are entitled to two (2) paid hours per day during the first six months and one (1) paid hour per day during the subsequent six months, scheduled at their convenience.
- Article 215: Employees may be granted exceptional unpaid leave for serious and urgent personal reasons, not exceeding ten (10) days per year.

The University ensures the implementation of these rights through its Human Resources Department in coordination with the Ministry of Higher Education and Scientific Research. All procedures related to maternity and paternity leave comply with the aforementioned national laws and institutional internal regulations.
